Terms of Service

The agreement between you and iTechVista covering the marketplace at code.itechvista.com. It describes what the platform does, what it charges, and what happens when something goes wrong.

1. Who you are contracting with

The marketplace at code.itechvista.com is operated by iTechVista (“iTechVista”, “we”, “the platform”). Questions about these terms go to our contact form.

These terms govern your use of the marketplace. The packages on it are sold by the developers who publish them, not by iTechVista. When you buy one, your payment goes to that developer and they are the merchant of record for the sale. iTechVista runs the marketplace, reviews every package before it can be listed, administers the refund policy below, and takes a commission.

Card payments are processed by our payment provider. We never receive or store your card number. Your payment is subject to that provider's own terms in addition to these.

2. Accounts

  • You must be at least 18, or the age of majority where you live, and able to enter a contract.
  • Sign-in is by emailed link or by GitHub or Google. Because access to your inbox is access to your account, you are responsible for keeping that inbox secure.
  • We require a second factor, a code from an authenticator app, before you can change where your earnings are paid or issue a refund to a card. You can turn two-factor authentication on at any time from account security, and we recommend every seller does.
  • One account per person. We may suspend an account that we reasonably believe is being used for fraud, to publish stolen code, or to abuse the request system.

3. Verification, and what it does and does not mean

Every package submitted for sale is reviewed before it can be bought. That review reads the actual uploaded archive, checks it for malicious code, hardcoded credentials and prompt-injection payloads, analyses its structure and dependency manifests, and compares its structural fingerprints against other submissions to detect resold or copied work.

What verification is not. It is an automated review, not a warranty. It does not guarantee that a package is free of bugs, fit for your particular purpose, or that it will keep working as its dependencies change. Not every package is executed; where a build was not run, the published report says so. Read the verification report before you buy.

4. Selling

  • You keep ownership of what you upload. You grant us the licence we need to store it, review it, display your description and preview, and deliver it to buyers.
  • You must have the right to sell it. Do not upload code you did not write or are not licensed to redistribute, and do not upload anything containing someone else's credentials or personal data. Detected plagiarism results in rejection and a strike against the account.
  • Listings are published only after review. You cannot mark your own listing verified, featured, or rated.
  • You set a Standard licence price (one project) and a Commercial licence price (unlimited projects, including redistribution inside your own SaaS). What each buyer receives is the licence they paid for.
  • Publishing an update leaves the current version on sale until the new one passes review, so buyers are never left without a working download.

5. Buying

  • Delivery is electronic and immediate: a licence key and a time-limited download link to the exact package version that was live when you paid.
  • A licence is for you or your organisation. It does not permit reselling the package as-is, or republishing it as your own work.
  • If a package you bought stops working, report it. Three separate buyer reports flag the listing and start a 7-day window for the seller to publish a fix; if none arrives, the listing is delisted. Delisting never removes your access, anything you have bought stays downloadable.
  • Refunds are covered by the Refund Policy, which forms part of these terms.

6. Fees

  • Marketplace commission: 15% of each sale, on every plan. A Pro subscription does not change it.
  • Posting a custom request: no fee. You deposit your budget and nothing is added to it.
  • Completing a custom request: 12% of the budget is withheld from the developer when the requester approves the work. This is the platform's only fee on a request.
  • Pro subscription: $29.00 per month, cancellable at any time. Cancelling leaves you on Pro until the period you have paid for ends.
  • Promotions. Where we run a discount code, the platform absorbs it: the seller is still paid their share of the full list price.
  • Tax. Every price shown on this site is before tax. Where the seller is required to add sales tax, VAT or GST, it is added at checkout, and the total you are asked to approve on the payment page is the amount you will be charged. Who accounts for that tax is set out in 6a.

6a. Who accounts for the tax

The seller is the merchant of record for their own sales. When you buy a package, the payment goes to the developer who published it. iTechVista operates the marketplace, reviews what is listed on it and takes a commission; it is not the seller of the package and does not receive the purchase price.

That means each seller is responsible for working out whether any sales tax, VAT or GST is due on their sales, and for collecting and remitting it, except where the law puts that duty on the marketplace instead. Where it does not, iTechVista does not calculate, collect, hold or file tax on a seller's behalf.

North Carolina is the exception, and it is not optional. North Carolina treats a marketplace facilitator engaged in business in the state as the retailer of every sale it facilitates, and requires it to collect and remit the sales tax on those sales whatever an agreement like this one says. iTechVista is established in North Carolina. So on a sale to a North Carolina buyer, iTechVista works out the tax, adds it at checkout, collects it and remits it to the Department of Revenue, and the seller must not charge tax on that sale as well. Other states impose the same duty: most once sales into them pass a threshold that state sets, and a few, including New Jersey and the District of Columbia, from the first sale with no threshold at all. iTechVista is not registered in those states and does not sell into them rather than collect a tax it cannot remit. Where any of this starts to apply, this page will say so before it does.

The same applies to a custom request: the developer who is paid for the work is the merchant of record for it, subject to the same North Carolina exception.

Prices shown on this site are the amount the seller has set. Where tax is due, whether the seller adds it or iTechVista does, it is added at checkout, and the total shown on the payment page before you approve it is the amount you will be charged.

Commission is calculated on the pre-tax price. Tax a buyer pays is never treated as anyone else's revenue and never reduces what a seller is paid.

If you need a tax invoice, ask through our contact form. Where iTechVista collected the tax, iTechVista issues the record of it. Otherwise we put you in touch with the seller, who issues it.

Sellers: this is not tax advice, and the paragraphs above are a description of the arrangement rather than a ruling on your obligations. Selling digital goods across borders can create registration duties in places you have never visited, and in some jurisdictions the rules treat a marketplace rather than a seller as responsible regardless of what an agreement like this one says. If you sell here at any volume, take your own advice.

7. Payouts

  • Each sale accrues to your payout ledger immediately, net of commission. It is not a payment until it settles.
  • New and Free-tier sellers carry a 7-day hold before an accrual becomes payable. Pro sellers with a trust score of 90 or above have no hold. The hold exists so a seller cannot ship broken code, withdraw, and abandon the account.
  • Settlement is to a payout account you connect and that our provider has verified. Until the provider enables payouts on that account, earnings remain accrued and are not lost.
  • We may withhold a payout while we investigate a credible report of fraud, plagiarism or chargeback abuse, and will tell you when we do.

8. Custom software requests

  • A requester deposits their budget up front, with nothing added to it. That money is held in escrow: iTechVista holds it, and neither party may take it, until the request is settled under this section. A request is only visible for claiming once the deposit has cleared.
  • A developer may hold at most 3 active claims. A claim that passes its deadline without a submission or a progress heartbeat is revoked, the request returns to the board, and the developer receives a strike. Three strikes block claiming for 14 days.
  • Heartbeats extend a claim by one deadline window, up to 3 windows in total. This bound exists so a claim cannot hold a requester's deposit indefinitely.
  • On submission the requester either approves, releasing payment to the developer, or disputes with a reason, which opens a 24-hour window for the developer to patch and resubmit.
  • If that window closes unanswered, the requester chooses: relist the request with the money still held in escrow, take the full budget as store credit with no fees deducted, or refund to the original card less the non-refundable payment processing cost.
  • A developer cannot approve their own work, and a request cannot be approved twice.

9. Store credit

Store credit is spendable on the marketplace and is not redeemable for cash. It is applied at checkout before any card charge. If you abandon a checkout, credit reserved for it is returned to your balance.

10. Acceptable use

Do not use the platform to:

  • upload malware, backdoors, cryptominers, or code designed to exfiltrate data;
  • attempt to defeat the review system, including by hiding behaviour from static analysis or embedding instructions intended to manipulate an automated reviewer;
  • infringe anyone's copyright, trademark or licence terms;
  • scrape, overload or probe the service beyond ordinary use, or circumvent rate limits and bot checks;
  • launder money, or transact on behalf of a sanctioned party.

11. Liability

The marketplace and the code sold through it are provided as is. To the fullest extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profits, or lost or corrupted data arising from code you obtained here.

Where liability cannot be excluded, our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.

Nothing here excludes liability for fraud, or for anything else that cannot lawfully be excluded.

12. Ending the agreement

You may stop using the platform at any time and ask us to close your account. We may suspend or close an account that breaches these terms. Closure does not cancel a settled payout we owe you, and it does not remove a buyer's access to something they have already paid for.

13. Changes

We may update these terms. The date at the top of this page always reflects the current version, and a change that materially reduces your rights will be announced on the site before it takes effect. Continuing to use the platform after that means you accept the updated terms.
